What is Alimony?

Alimony is a court-ordered financial allowance paid by one spouse to the other to maintain a balance in standard of living during and/or after a divorce.

Will I Be Able to Get Alimony?

The grant of alimony is entirely at the court's discretion. It is not automatic. While it can be difficult to assess exactly what a court will do in determining alimony obligations, it will base its decision on various factors such as:

  • Relative incomes of each party
  • Length of marriage
  • Age and health of the parties
  • Whether the party can be self-supporting
  • Whether one party needs education to become self-supporting
  • Each party's monetary and non-monetary contributions to the marriage
