How Will Child Support Be Calculated?

One of our primary concerns as your legal representative is ensuring the fair calculation of child support. Whether you are interested in collecting child support or you are seeking to prevent unmanageable obligations, we will review your financial status and ensure that you and your child are secure.

The court will take the following actions to determine child support:

  • Obtain information on each party's income and/or potential income
  • Assess the cost of health insurance, day care, any extraordinary medical expenses
  • Apply the Maryland child support formula to this information to arrive at the figure

Maryland guidelines only address situations up to $120,000 in combined income. If a couple exceeds that amount, further calculations are needed to determine the child support amount. The court has discretion to arrive at figure based on family experience and standard of living.

Enforcement of Child Support Orders

We are experienced in representing our clients' interests in the enforcement of support orders. If you are owed child support and are seeking to collect back payments, we can explore every course of legal action to collect the child support payments you are due.

Modifications

A "material change in circumstances" that affects your financial security may warrant a modification to an existing order. If you have suffered a loss of job or if a custodial parent has had an increase pay, so that basis of original order doesn't apply, you may be entitled to a modification of an existing order. A modification can either be an increase or a decrease depending on the specific change in circumstances. We will assess situation and attempt modification without going to court, but will file a petition if needed.
