It is not uncommon for a family law attorney to hear from individuals who are completely undecided about whether or not they should file for divorce. In these cases, it is the attorney’s job to inform the individual about the various aspects of divorce they should be take into consideration while making their decisions. Some of this information relates to what divorce cannot do, as it is important that everyone keep a realistic perspective when going into the process.

First, divorce cannot guarantee that spouses will be receive equal treatment in asset division proceedings. No two individuals and no two families are the same, so family law judges have to decide asset division matters on a case-by-case basis. As such it is difficult to predict what the results will be before initiating the process.

Second, divorce cannot guarantee civil relations. Even though the divorce agreement will be set, or a court will mandate certain divorce results, the spouses still need to follow these decisions, and there is no guarantee that a spouse will follow a child custody order or spousal support order in Maryland. As such, further litigation could potentially be required to enforce a divorce agreement.

Third, divorce cannot guarantee that spouses will maintain their standards of living. Considering that from an economic perspective it is less expensive for two individuals to share their living standards, divorce could result in a decrease in living standards after these expenses are no longer shared.

Catonsville residents can get a deeper understanding of what their divorce can and cannot do for them by discussing the facts pertaining to their family and marriage with an experienced Maryland divorce lawyer. A lawyer can tell you in detail what you and your family need to prepare for before you file.
